Know Your Lemon Law Rights: What to Do If You Buy a Defective Car
Buying a car is always a significant investment, and usually a long-term one. But what if the long-awaited car starts breaking down almost immediately after purchase? This situation is as common as it is unpleasant. But if this happens in California, you may at least have legal grounds to protect your rights under the so-called Lemon Law.
At Xtreet, we not only help with vehicle registration, but we also make sure that every California driver knows how to protect themselves in the event of purchasing a “lemon” - that is, a car with chronic malfunctions.
What is Lemon Law in California?
The California Lemon Law, officially known as the Song-Beverly Consumer Warranty Act, guarantees protection to buyers of new and certain used cars that are defective and cannot be properly repaired after a reasonable number of attempts.
The law applies to:
- New vehicles purchased or leased in California,
- Used cars that are still covered by the manufacturer's warranty,
- Cars, pickup trucks, vans, and SUVs purchased or leased for personal, family, or household use.
Important: the vehicle must not be a second-hand vehicle, but rather purchased or leased from a licensed California dealership or directly from the manufacturer. Also, the Lemon Law does not apply to:
- Vehicles not registered under the California Vehicle Code, such as off-road vehicles.
- Vehicles that have been abused or misused.
How do you know if your car is a “lemon”?
A car is considered a “lemon” if:
- The problem significantly affects the safety, value, or functionality of the car.
- The manufacturer or dealer has not fixed the problem after 2-4 repair attempts.
- The car has not been used for more than 30 days due to repair work (not even consecutively).
What should you do if you suspect you have a lemon?
Be sure to follow these tips to get a refund or even a new car:
- Document every repair.
- Keep invoices, receipts, and correspondence with the dealer and service.
- Notify the dealer or manufacturer in writing. An official notification is the key to starting the Lemon Law procedure.
- Ask for a refund or a replacement car: you are entitled to a full refund or a new car.
- Consult a lawyer or file a claim. Many lawyers work on a “pay as you win” basis.
